Colorado State Laws Against Collection Harassment

In an effort to protect the financial and emotional well being of American consumers, Congress passed the Fair Debt Collection Practices Act (FDCPA) in 1978, which makes it illegal for collectors to abuse or use deception to collect payments on outstanding debts.

In addition to the FDCPA, the state of Colorado offers additional consumer protections through the Colorado Fair Debt Collection Practices Act (Colorado FDCPA), which covers third-party debt collectors.

Colorado consumers are also protected by the Colorado Uniform Consumer Credit Code, which applies to creditors collecting their own debts. In Colorado, debt collectors are prohibited from harassing you, but so are the original creditors.

How the FDCPA Protects Colorado Consumers

Covering the collection of consumer debt, the Colorado FDCPA regulates the ways a debt collector can obtain information to find the consumer. In addition to these protections, the Colorado FDCPA also provides Colorado consumers with the right to have their debt validated.

How does this process work?

Upon receiving notice that the debt is being collected, the consumer may choose to dispute the debt in writing. This requires the collector to validate the debt, declaring the amount and the creditor to whom the debt is owed. The collector may not collect upon a disputed debt until it has been verified.

Deceptive language (implying the debtor has committed a crime).
